Welcome to Claire Expressions. These Terms of Service (“Terms”) govern your use of our website and your purchase of products and services from Claire Expressions.

By visiting our website, placing an order, purchasing a digital product, or accessing the Claire Expressions Customer Vault, you agree to these Terms.

1. OUR PRODUCTS

Claire Expressions offers products that may include:

Digital sublimation designs and downloadable files
Digital design bundles and collections
Customer Vault access
Digital planners and other digital products
Tumblers, water bottles, and other physical products
Custom and personalized products

Product availability, pricing, designs, and collections may change without notice.

We make reasonable efforts to display product descriptions, images, dimensions, and colors accurately. However, colors may appear differently depending on your screen, printer, sublimation equipment, materials, and settings.

2. DIGITAL PRODUCTS

Digital products are delivered electronically. No physical product will be shipped when purchasing a digital-only listing.

Customers are responsible for reviewing the product description and ensuring that the file type, dimensions, software, equipment, and intended use meet their needs before purchasing.

Digital purchases are subject to our Refund & Return Policy and Digital File License.

3. DIGITAL FILE LICENSE

Unless otherwise stated, purchasing a digital file provides the purchaser with a limited license to use the file according to the usage terms provided by Claire Expressions.

Purchasing a digital product does not transfer ownership or copyright in the design.

Unless expressly permitted in the applicable product license, customers may not:

Resell the digital file itself
Share or give the digital file to another person
Redistribute the file
Upload the file to file-sharing websites or groups
Claim the artwork or design as their own
Include the original digital file in another digital bundle
Make the file available for others to download
Transfer their purchase or download access to another person

Where a product listing or license permits small-business commercial use, customers may use the applicable design to create and sell finished physical products subject to those terms.

Additional restrictions may apply to particular products and will be stated in the applicable listing or license.

4. CUSTOMER VAULT

The Claire Expressions Customer Vault is a digital-access product.

A Customer Vault purchase provides the original purchaser with access to the eligible digital designs currently included in the Vault and eligible future designs added to the Vault, subject to these Terms.

Vault access does not necessarily include every product Claire Expressions currently sells or may create in the future.

Custom designs, commissioned artwork, personalized designs, certain licensed content, physical products, special releases, or other specifically excluded products may not be included.

Customer Vault access is for the purchaser only. Login information, download links, files, or other access methods may not be shared, transferred, resold, or distributed.

Claire Expressions may modify the organization, delivery method, hosting platform, or contents of the Vault. We may also discontinue or replace individual files when reasonably necessary, including because of licensing, legal, technical, or business requirements.

Any description of “lifetime access” refers to access for as long as the applicable Customer Vault service is offered and maintained by Claire Expressions, subject to these Terms and applicable law. It does not guarantee that Claire Expressions, the website, or any third-party hosting service will operate indefinitely.

5. CUSTOM & PERSONALIZED ORDERS

Customers are responsible for providing accurate customization information, including names, spelling, colors, photographs, sizes, and other requested details.

Please review personalization information carefully before submitting your order.

Once production begins, changes or cancellations may not be possible.

Claire Expressions is not responsible for errors resulting directly from incorrect information supplied or approved by the customer.

6. ORDERS & PAYMENT

By placing an order, you represent that the information provided during checkout is accurate and that you are authorized to use the selected payment method.

Prices are displayed on the website and may change without notice.

Applicable taxes, shipping charges, discounts, and other fees will be displayed as appropriate during checkout.

Submitting an order does not require Claire Expressions to fulfill an order affected by an obvious pricing or listing error, suspected fraud, product unavailability, or another legitimate reason permitted by law. If an order is canceled after payment has been collected, any required refund will be issued according to applicable law and our policies.

7. PROMOTIONS & DISCOUNT CODES

Promotions, discount codes, bundle pricing, giveaways, and special offers may be subject to additional terms.

Unless otherwise stated, promotional offers cannot be combined.

Claire Expressions reserves the right to modify or end promotional offers, subject to applicable law and any terms stated when the promotion was offered.

8. SHIPPING

Physical orders are subject to our Shipping Policy.

Processing time and shipping time are separate. Delivery dates provided by carriers or displayed during checkout are estimates unless expressly stated otherwise.

Digital products do not require shipping.

9. RETURNS, REFUNDS & CANCELLATIONS

Purchases are subject to our Refund & Return Policy.

Because digital products cannot generally be physically returned after delivery or access, eligibility for refunds may differ from physical products.

Custom and personalized physical products may also have different return or cancellation eligibility because they are created specifically for the purchaser.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the Claire Expressions website, branding, logo, original graphics, original designs, product photography, written content, and other original materials owned by Claire Expressions are protected by applicable intellectual-property laws.

No purchase grants ownership of Claire Expressions intellectual property except for the limited usage rights expressly provided with the purchased product.

Third-party trademarks, artwork, or other intellectual property, where applicable, remain the property of their respective owners.

11. PROHIBITED USE

You may not use our website, products, downloads, or services to:

Violate applicable laws or regulations
Commit fraud
Distribute malicious software
Attempt unauthorized access to our website or accounts
Copy or redistribute digital products contrary to their license
Share Customer Vault access
Misrepresent Claire Expressions products as your own original digital artwork
Infringe the intellectual-property rights of Claire Expressions or others

We may restrict access to our services when reasonably necessary to address fraud, abuse, unauthorized file sharing, security concerns, or violations of these Terms, subject to applicable law.

12. THIRD-PARTY SERVICES

Our website may use or link to services provided by third parties, including payment processors, shipping carriers, digital-delivery services, social-media platforms, and Shopify.

Those third-party services may be governed by their own terms and privacy policies.

Claire Expressions is not responsible for third-party services to the extent permitted by applicable law.

13. WEBSITE AVAILABILITY

We work to keep our website and digital services available, but uninterrupted or error-free operation cannot be guaranteed.

Maintenance, technical problems, internet outages, third-party platform interruptions, or other circumstances may temporarily affect availability.

If you experience difficulty accessing a purchased digital product, please contact us so we can assist.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Claire Expressions will not be liable for indirect, incidental, special, or consequential losses resulting from the use or inability to use our products, website, or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our products, services, business practices, or legal requirements.

The current version will be posted on our website with an updated revision date.

For purchases already made, any rights and obligations that arose under the terms applicable at the time of purchase remain subject to applicable law.

16. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

17. ENTIRE AGREEMENT

These Terms, together with our Refund & Return Policy, Shipping Policy, Privacy Policy, applicable Digital File License, Customer Vault terms, and any product-specific terms, form the agreement governing purchases and use of Claire Expressions products and services.
